Read our Terms and Conditions to understand the legal agreement governing your use of our services, including our inspection process, customer obligations, and
liability limitations.

  1. Orlando Inspex agrees to perform a visual inspection of the apparent, pertinent, and readily accessible parts of the home/building and to provide CLIENT with a written inspection report. Orlando Inspex is not required to dismantle items or enter areas that may be deemed unsafe in the Inspector’s professional opinion. Orlando Inspex may offer comments as a courtesy, but these comments will not comprise the bargained-for report.

 

  1. If CLIENT is in the process of purchasing a home/building that is to be inspected for insurance purposes, the report(s) produced by Orlando Inspex is/are only supplementary to the seller’s disclosure, a Pre-Purchase inspection, and any other reasonable inspections that take place in a real estate transaction. A purchase decision should not be made by using information gathered from an insurance inspection. If deficiencies/defects are found in the insurance inspection(s) performed by Orlando Inspex, CLIENT should seek further council with appropriate and qualified professionals.

 

  1. It is the responsibility of the homeowner or prospective homeowner to provide to Orlando Inspex permit information, or other pertinent information if permit information is not required for the work that was performed. Orlando Inspex may perform permit searches as a courtesy, but shall not be liable for inaccurate or missing information. Orlando Inspex relies on information provided by building departments, property appraisers, or other public sources in Orlando Inspex’s research efforts, which may have errors or omissions. It is CLIENTS responsibility to review the report, and advise Orlando Inspex of any discrepancies. If discrepancies are present, it is the responsibility of CLIENT to provide Orlando Inspex with any pertinent information to substantiate changes in the report(s). Orlando Inspex reserves the right to make changes at its sole discretion.

 

  1. CLIENT understands that insurance companies may require estimated life expectancies of home systems, components, appliances, materials, and structure. It is impossible to know the exact time or date something in a home will fail. When an insurance company requires life expectancies, Orlando Inspex’s inspectors will make estimates based on their professional opinion. CLIENT understands and accepts that these estimates may be higher or lower than what actually may happen over time.

 

  1. Orlando Inspex relies on CLIENT to know what inspection(s) is/are to be performed. It is the responsibility of CLIENT to confirm with their Insurance Agent on the correct inspection needed for CLIENT’s insurance policy. If CLIENT mistakenly orders an incorrect inspection, Orlando Inspex will not provide a refund to CLIENT.

 

  1. The inspection and report are performed and prepared for the use of CLIENT, who gives Orlando Inspex permission to discuss observations with any interested parties (including, but not limited to, real estate agents, owners, repairpersons, insurance agents, etc.) Orlando Inspex accepts no responsibility for use or interpretation by third parties.

 

  1. CLIENT acknowledges that, if this inspection is at the request of CLIENT’s insurance company, it is CLIENT’s responsibility to determine that Orlando Inspex’s qualifications are acceptable to that insurance company and the report(s) to be produced by Orlando Inspex meets the requirements for the insurance company.

 

  1. Orlando Inspex may request the CLIENT’s Insurance Agent contact information in order to send report(s) via email or fax. This is as a courtesy only. Orlando Inspex is not obligated to send report(s) to agent(s). It is the responsibility of the CLIENT to provide a copy of any reports by Orlando Inspex to their Insurance Agent or verify that their Insurance Agent received a copy of the report(s) from Orlando Inspex. Orlando Inspex will not be responsible for any damages resulting from CLIENT’s Insurance Company not receiving report(s) from Orlando Inspex.

 

  1. CLIENT understands and agrees that Orlando Inspex is not an insurer and that the inspection of the property and the accompanying report are in no way intended to be a guarantee or warranty, express or implied, regarding the future use, operability, habitability or suitability of the home/building, or its systems and components. Any and all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose are expressly excluded by this Agreement.

 

  1. LIMITATION OF LIABILITY: Orlando Inspex assumes no liability for the cost of repair or replacement of unreported defects or deficiencies either current or arising in the future. CLIENT acknowledges that the liability of Orlando Inspex, its agents, and employees for any and all liabilities, demands, claims, damages, expenses incident thereto for injuries to persons, costs of defense or suit, attorney’s fees and expenses and payments arising out of or related to Orlando Inspex’s negligence or breach of any obligation under this Agreement, negligent
  2. misrepresentation, negligent hiring, or any other theory of liability, including errors and omissions in the inspection or the report, shall be limited to liquidated damages in an amount equal to twice (2x) the fee paid to Orlando Inspex, and this liability shall be exclusive. CLIENT waives any claim for consequential, exemplary, special or incidental damages or for the loss of the use of the home/building even if CLIENT has been advised of the possibility of such damages. The parties acknowledge that the liquidated damages are not intended as a penalty but are intended (i) to reflect the fact that actual damages may be difficult and impractical to ascertain; (ii) to allocate risk among Orlando Inspex and CLIENT; and (iii) to enable Orlando Inspex to perform the inspection at the stated fee.

 

  1. In the event that anyone or any entity claims damages as a result of the reliance upon the Inspection Report, and seeks recompense for said damages from Orlando Inspex, CLIENT agrees to indemnify, defend, and hold harmless Orlando Inspex, its agents, and employees from any third party claims arising out of CLIENT’s distribution of the Inspection Report, including, but not limited to, any claims caused by the alleged negligence, breach of contract, fraud, misrepresentation, or any other theory of liability of Orlando Inspex.

 

  1. In the event of a claim against Orlando Inspex, CLIENT agrees to supply Orlando Inspex with the following: (1) Written notification of the specific claimed defect within 10 days of discovery, and (2) Access to the premises. Failure to comply with the above conditions will release Orlando Inspex and its agents from any and all obligations or liability of any kind.

 

  1. Client understands and agrees that if he or she is not present at the time of the inspection or do not sign this Inspection Agreement that this Agreement will become part of the Inspection Report, and therefore delivery of the Inspection Report to the Client (by mail, in person or via internet) will constitute acceptance of ALL the terms and conditions of this Agreement.

 

  1. Client understands that Orlando Inspex relies on information from various sources to complete inspections. Because of that, Orlando Inspex is not always in control of how much time it takes for an inspection to be ready for delivery to CLIENT. Orlando Inspex is not liable for any inspections that are performed and do not get completed within CLIENT’S desired turnaround time.

 

  1. Severability: If at any time subsequent to the date hereof, any provision of this Agreement shall be held by any court of competent jurisdiction to be illegal, void, or unenforceable, such provision shall be of no force and effect, but the legality or unenforceability of such provision shall have no effect upon and shall not impair the enforceability of any other provision of this Agreement.

 

  1. Dispute Resolution: Any controversy or claim between the parties hereto, arising directly or indirectly out of, connected with, or relating to the interpretation of this Agreement, the scope of the services rendered by the Inspector, or as to any other matter involving any act or omission performed under this Agreement, or promises, representations or negotiations concerning duties of the Inspector hereunder, shall be submitted to Small Claims Court. If the alleged damages exceed the jurisdictional limit for Small Claims Court, the dispute shall then be submitted to binding arbitration before Construction Dispute Services or Resolute Systems. Any claims must be presented within one (1) year from the date of the inspection; Inspector shall have no liability for any claims presented more than one (1) year after the date of the inspection.

 

  1. Payment for service(s) rendered by Orlando Inspex is/are due upon start of the on-site inspection(s). If payment is not received at time of inspection, CLIENT’s report(s) will not be released until payment is received in full.

 

  1. CLIENT agrees to pay all fees and costs incurred in collecting past due payments, including attorney or collection agency fees, if any. CLIENT also agrees to pay interest in the amount of 1-1/2% per month, or the highest rate permitted by law, whichever is greater, on any payment that is considered past due until collected in full. Should any check from CLIENT be dishonored, CLIENT must immediately make payment to Orlando Inspex in the form of (1) a cashier’s check, or (2) money order, or (3) cash; any of which will include the original amount due plus an administrative fee of fifty ($50.00) dollars or 5% of the face amount of the check, whichever is greater, and damages in accordance with §68.065, Florida Statutes.

 

  1. If CLIENT is a corporation, LLC, or similar entity, the person signing this Agreement on behalf of such entity does personally guarantee payment of the fee by the entity and affirms his or her personal liability for any such debt.
